Consent and leads: how to buy without risk

Consent is the border between a lead you can work calmly and one that's a problem waiting. Learn to tell them apart before you pay.

If one word decides whether a lead is safe or dangerous, it's consent. A lead with valid consent is an asset you can work with peace of mind. One without it is a risk no sale compensates. Knowing how to tell them apart before buying is basic.

What valid consent is

A hidden checkbox isn't enough. Valid consent under the GDPR is free, specific, informed and unambiguous: the person agreed clearly, knowing what their data would be used for and, if applicable, that it could be transferred to third parties for commercial purposes. A generic "I accept the terms" doesn't cover the transfer for you to call them.

The question that sums it up: did this person expect to hear from you? If the honest answer is no, the consent probably doesn't cover what you're about to do.

How to verify it when buying

  1. Ask the provider for the exact wording of the consent the lead accepted.
  2. Check it includes transfer to third parties or your type of company.
  3. Ask how and when it was recorded (proof of consent).
  4. Confirm the purpose fits what you'll offer.

This should be in the SLA. If the provider can't produce it, that's a red flag.

Consent expires and is revoked

Consent from years ago, or one the person already revoked, doesn't count. So freshness and opt-out management matter: working a lead who objected is an infringement. Keep your lists clean and honor every opt-out instantly.

Your first contact informs too

When you contact the lead, identify yourself, say where you got their data and make it easy to exercise their rights. That transparency doesn't just comply: it builds trust and improves the conversation, as we saw in the call script.
