GDPR and buying leads: what's legal and what isn't

Buying leads is perfectly legal, done right. Done wrong, it can cost you a fine that eats any sale. Here's what you need to know, no jargon.

There's a persistent myth: that buying leads is alegal or a grey area. It isn't. Buying leads is perfectly legal as long as the data processing complies with the GDPR. The problem isn't the purchase: it's buying from providers who don't respect the rules. Here's the essential, in plain terms.

The key piece: legal basis

To process personal data you need a legal basis. In acquisition, the most common and safest is consent: the person agreed their data could be used to receive commercial information, ideally including transfer to third parties like you. Without a valid legal basis, contacting that lead is an infringement.

What a "legal" lead must meet

  • Informed consent: the person knew what they left their data for and to whom it could be transferred.
  • Documented origin: the provider can prove where and how it was obtained.
  • Compatible purpose: you use the data for what was consented, not something else.
  • Guaranteed rights: the person can access, rectify and object easily.

Signs of a problematic lead

Be suspicious if the provider doesn't know (or won't) explain the data origin, sells mass "databases" with no transfer consent, or prices suspiciously low for the volume. A cheap lead with no legal basis is a time bomb, not a bargain.

Your responsibility as a buyer

Here's the important part: responsibility isn't only the provider's. As the one processing the data, you respond too. So demand traceability and guarantees in the SLA, inform the contact on first contact, and enable their rights. Buying from a serious provider protects you; buying the cheapest exposes you.

Buying leads doesn't put you at risk. Buying leads with no legal basis does. The difference is who you buy from and what you demand.
